This supposes passing the court test. Just because something is in terms of 
agreement, and just because you agree to those terms, does not mean the terms 
themselves will have any validity whatsoever. I don't know how many times I've 
signed documents ostensibly absolving the people or company giving me the 
document from any responsibility for the outcome. I usually just grin at them 
and say, "You know this isn't worth the paper it's printed on?"

They usually don't meet my eyes. Sometimes they chuckle.
